2. General rules

(a) The present "General Terms and Conditions" - hereinafter referred to as the "GTC" - regulate the conditions of use of the Greenwood Guest House accommodation operated by the Service Provider at 11 Vécsey Károly utca, 8600 Siófok, and other related services provided by the Service Provider.
(b) The present GTC do not exclude the conclusion of special or individual agreements with travel agencies, travel intermediaries, tour operators or other persons who wish to cooperate with the Service Provider in the long term in order to sell the Service Provider's services.

(c) The Hungarian language version of these General Terms and Conditions shall prevail.
Any translations into foreign languages are for information purposes only and are not legally binding.

3. the contracting party

(a) The contracting party is the natural person, legal entity or unincorporated business entity ordering or using the services of the Service Provider. The contracting party is also the natural person who actually uses the services of the service provider. The person ordering and/or using the service is hereinafter collectively referred to as the "Guest".
(b) The Service Provider and the Guest - provided that the contractual conditions are fulfilled - are hereinafter collectively referred to as the "Contracting Parties".

4. Establishment of the service contract, booking procedure, modification of the booking

(a) In response to the Guest's written request for an offer, sent by e-mail via the booking system of the website www.greenwoodsiofok.hu, the Service Provider will confirm the reservation to the Guest within 24 hours of receipt of the request. (b) The Service Contract shall be deemed to have been concluded upon written confirmation by the Service Provider of the order - reservation placed by the Guest, and with regard to such written confirmation, the order - reservation shall be deemed to have been concluded in writing. An order placed orally and/or an amendment to an order shall only constitute a contractual obligation if confirmed in writing by the Service Provider. Verbal confirmation of the order or order modification by the service provider does not create a contractual obligation. (c) The contract for the use of the service is concluded for a limited period. (d) In the event that the Customer decides before the expiry of the fixed term not to use the service until the expiry of the fixed term, he shall still be obliged to pay the full price of the service to the Service Provider and the Service Provider shall be entitled to claim the full price of the ordered service. The Service Provider shall be entitled to resell the apartment abandoned by the Guest before the expiry of the fixed term. (e) The Guest is only entitled to extend the service if the Service Provider agrees in writing no later than the day before the expiry of the fixed term. (f) The service contract may only be amended with the written and unanimous consent of the Contracting Parties.

5. Modification and cancellation conditions

You are free to cancel or modify your reservation up to 7 days before the arrival date (at the prices valid at the time of modification), after which the fee will be 25% of the total amount of the reservation. The deposit paid or the card details provided at the time of booking may be used to cover the penalty in the event of late cancellation.

6. Prices applied by the Service Provider

(a) The current prices of Greenwood Guesthouse are those shown on the website www.greenwoodsiofok.hu. (b) The Service Provider is free to change its prices at any time without prior notice, provided that this does not apply to prices already offered by the Service Provider in its quotation at the request of the Contracting Party. (c) The Service Provider shall indicate in the prices quoted the statutory rate of the tax content of the prices, e.g. value added tax (hereinafter: VAT), tourist tax (hereinafter: IFA). The Service Provider reserves the right to pass on additional charges to the Contracting Party and/or the Guest without prior notice in the event of a change in legislation. (d) The Service Provider is entitled to set its prices in Hungarian forints and in any convertible currency. (e) The Service Provider undertakes to publish its current prices, current promotions, discounts and other offers on the website www.greenwoodsiofok.hu operated by the Service Provider. (e) Special periods.

7. Method and guarantee of payment

(a) The Service Provider shall indicate the total amount of the ordered services, calculated for the whole stay, on the written confirmation sent to the Guest. The Guest may settle the total amount due for the duration of the stay on the spot by cash, credit card or SZÉP card. No credit card or other payment details will be passed on to the merchant. The service provider Barion Payment Zrt. is an institution supervised by the National Bank of Hungary, licence number H-EN-I-1064/2013.

8. How and under what conditions to use the service

(a) The Guest may occupy the Greenwood Guesthouse ordered and confirmed by the Service Provider from 14:00 on the day of arrival - "check in" - and must leave it by 10:00 a.m. on the last day of stay - "check out". (b) In the event that the Guest wishes to occupy the apartment prior to the check-in time specified in clause 8(a) on the day of arrival, he/she may do so subject to availability at an additional charge. (c) The Supplier shall be entitled to terminate the contract for the accommodation service with immediate effect or refuse to provide the service if: -The Guest does not use the guest house made available to him/her for the intended purpose or does not use the services provided by the Service Provider and/or the premises for the provision of such services and/or premises for the intended purpose, -disturbs the rules of the Greenwood Guesthouse and does not cease to disturb the Guesthouse despite being requested to do so, -The Guest does not comply with the Greenwood Guest House safety rules - e.g. smoking in a prohibited area and does not stop smoking despite being told to do so, -The Guest behaves in an inappropriate manner, is rude, under the influence of alcohol or drugs, threatening, abusive or other unacceptable behaviour, -the Guest fails to fulfil the obligation to provide the payment guarantee requested by the Service Provider by the date set by the Service Provider. (f) If the contract between the Contracting Parties is not performed due to "force majeure", the contract shall be terminated. (g) The Guest shall use all the services of the Greenwood Guesthouse at his own risk during the entire stay. (h) The Guest may only invite additional guests, guests other than the contracting party and/or guests to the holiday home area, or use any services, subject to prior notification, if the Guest confirms this to the Service Provider.

9. Provision of services

(a) If the Service Provider is unable to provide the ordered services due to its own fault, in particular: overloading, temporary operational problems, it is obliged to arrange accommodation for the Guest. (b) The Service Provider shall, within the scope of its obligation under (a): To offer the services confirmed in the order at the price indicated therein, for the period stipulated therein - or until the end of the impediment - to another accommodation of the same or higher category and to provide them if accepted by the Guest. All additional costs of providing the replacement accommodation shall be borne by the Supplier. Provide the Guest, on request and free of charge, with a single telephone call to communicate the change of accommodation to the person indicated by the Guest. If the Service Provider fully complies with the obligations set out in (b) or if the Guest accepts the alternative accommodation offered to him, the Guest shall not be entitled to claim any subsequent compensation.

10. Rights of the Guest

(a) under the contract, the Guest is entitled to use the apartment booked and the facilities of the accommodation which are included in the normal range of services and which are not subject to special conditions, (b) the Guest may complain about the performance of the services provided by the Supplier. The Service Provider undertakes to investigate and provide the Guest with a substantive reply to any complaint submitted to it in writing or orally on the spot and recorded in the minutes within 72 hours of receipt.

11. Obligations of the Guest

(a) the Guest shall pay the Provider the price of the services ordered in the contract no later than the time and in the manner specified in the contract, (b) the Guest must immediately report any damage suffered by him/her to the accommodation provider and provide the Operator with all the necessary information required to clarify the circumstances of the damage or to initiate any infringement or criminal proceedings, (c) the Guest is obliged to check on arrival that the conditions and services provided are in conformity with the guarantee of satisfaction. The Guest is obliged to make a declaration to this effect before the Service Provider leaves the accommodation after the handover. The Service Provider cannot accept any subsequent complaints after the accommodation has been taken over, in which case the advertised guarantee will not be valid, (d) in the event of any equipment malfunctioning during the stay, if the Guest requires its repair, the Guest shall immediately notify the Service Provider and request its repair, no subsequent claim shall be accepted by the Service Provider.

12. The Guest's liability for damages

(a) the Guest shall be liable for any damage caused by the Service Provider or any third party to the Guest or his/her companion or any person under the supervision of any of these persons. (b) The Guest shall also be liable to pay compensation even if the injured party is entitled to claim compensation for the damage directly from the Service Provider.

13. Rights of the Service Provider

If the Guest fails to comply with the obligation to pay the fee for the ordered services when requested to do so, but shows up at the accommodation, the Service Provider has the right to refuse the service and keep the paid accommodation fee according to the "Cancellation conditions" set out in section 5.

14. Obligations of the Service Provider

(a) the Service Provider shall provide the accommodation and other services ordered under the contract in accordance with the applicable regulations and service standards, (b) the Service Provider shall investigate the guest's written complaint and deal with the problem.

15. Liability of the Service Provider for damages

(a) the Service Provider shall be liable for any damage caused to the Guest within the apartment, within the scope of the Service Provider's liability, (b) the Service Provider shall not be liable for any damage caused by any cause beyond the control of the Service Provider's employees and guests or caused by the Guest or persons under the Guest's supervision, (c) the Service Provider reserves the right to designate a place(s) inside and outside the Greenwood Guest House where the Guest shall not enter or remain. The Supplier shall clearly mark such places. The Supplier shall not be liable for any damage caused to the Guest or persons under the Guest's supervision in the place(s) where the Guest is not allowed to enter after having been informed in advance by the Supplier, (d) the Service Provider shall only be liable for damages if it reports the damage to the Service Provider immediately after the damage has occurred, with the necessary information, (e) the Service Provider's liability does not extend to the contracting party's luggage and its contents on arrival and departure, on loading and unloading, and during transport to and from the apartment, (f) the amount of the Supplier's liability for damages shall not exceed five times the amount of the daily accommodation fee under the contract.

16. Confidentiality

(a) In fulfilling its obligations under the contract, the Service Provider shall act in compliance with the provisions of Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information (hereinafter referred to as the "Information Act") and the relevant legislation on data protection and other internal rules established by the Service Provider.

17. Vis maior

(a) any cause or circumstance (e.g. war, fire, flood, adverse weather conditions, power failure, strike, etc.) over which neither the Service Provider, the Guest nor the Contracting Party has control - force majeure - shall relieve either party from the performance of its obligations under the contract for as long as such cause or circumstance exists. The Contracting Parties agree to use their best endeavours to minimise the possibility of such causes or circumstances occurring and to remedy any damage or delay caused thereby as soon as possible.

18. Complaints handling / conciliation body

19. Applicable law and competent court in relations between the Contracting Parties

(a) the provisions of Act V of 2013 on the Civil Code shall apply mutatis mutandis to the legal relationship between the Contracting Parties, (b) in the event of any dispute relating to the contract, the party concerned may apply to the courts. The Contracting Parties shall designate the District Court of Siófok as the competent court for the resolution of any disputes.

20. Data management

The personal data provided by the guest will be processed solely for the purposes of contacting you, fulfilling your reservation and fulfilling our legal obligations. Detailed information is available in the Privacy Policy.

21. Data protection investigation, data protection authority procedure

If the data subject wishes to lodge a complaint regarding the processing of his or her personal data, he or she may do so with the National Authority for Data Protection and Freedom of Information, in compliance with the provisions of the Data Protection Act (www.naih.hu).

22. Additional provisions

By using the services available on the Service Provider's website, the User accepts the terms and conditions listed here. The Service Provider has made all reasonable efforts to ensure that all information provided on the website is accurate at the time of uploading. Nevertheless, the Service Provider does not assume any responsibility or warranty, express or implied, for the information provided through the website and reserves the right to make changes and corrections to it or to discontinue the website or the information provided on it, in whole or in part, at any time without notice. The Provider shall not be liable for any technical errors or omissions in the website. The offers are not legally binding and do not constitute any form of obligation for the Service Provider. Any decision based on the information on the website is the sole responsibility of the User. The Service Provider shall not be liable for any loss or damage of any kind arising from access to, or failure to access or use, the website or any information contained therein. The Service Provider shall not be liable for any content created, transmitted, stored, made available or published by third parties to which the Service Provider's website is linked or referred to. The Service Provider does not guarantee that access to the website will be uninterrupted or error-free.
